Magnolia Table Restaurant owner, Chip and his attorneys tried to crush the notice for deposition and argued while hearing on Friday, July 27th, 2019. They claimed the opposition has no case and are only trying to threaten Gaines' reputation. Furthermore, the judge of 170th State District Court, Jim Meyer agreed to postpone a hearing on Gaines motion to decline the lawsuit. Nevertheless, Chip still has to provide a deposition even if the case is dismissed later.

One of Gaines' attorneys, B. Todd Patterson said,

"We just think that this case needs to go away, that is why we filed our summary judgment motion, and we are looking forward to getting an opportunity to argue that before the court and get this case dismissed."

The judge filed a lawsuit for $1 million, back in April 2017, with the defendants being Magnolia Realty, High Noon Productions, and Scripps Network. As per The Waco Tribune, the motion stated,

"Two weeks later, Defendant Gaines finally pressured plaintiffs into selling their shares to him, and he took sole ownership of Magnolia Realty. Two days later, Defendant Gaines announced on Facebook that the pilot for Fixer Upper had been ‘fast-tracked’ three weeks earlier, which was before he approached Plaintiffs about buying them out of Magnolia Realty."

Chip Gaines is currently focused on the series about his farmhouse, alongside his wife Joanna Gaines. Moreover, the recent issues regarding his civil lawsuit need to be fixed as soon as possible and Chip looks set to work on it.
