Spencer Elden is now suing the band Nirvana for his naked baby picture used for the Nevermind album cover. Elden is alleging it was child porn.

Spencer Elden, known for appearing as a naked baby on one of rock music's iconic album covers, now a month before Nirvana's Nevermind turns 30, is suing the band. Spencer claims to be sexually exploited as a baby.

A lawsuit filed in a Californian district court includes the survivor members of the band, Kurt Cobain's widow Courtney Loveand the record labels were responsible for releasing & distributing the album in the 1991 hit album Never Mind.

In addition, Elden accuses the defendants of using child pornography that depicts himself. Eden also accuses that the band posed him as a child in a sexually provocative manner on the album cover to drive sales and gain notoriety. Further, he also claims the band used it as an essential part of a record/album promotion to garner critical review & public attention.

Likewise, the lawsuit claims that the image is 'sexually graphic' and says it makes Elden resemble 'a sex worker- grabbing for a dollar bill dangling from a fishhook.'

On the other hand, Elden's legal team, Marsh Law, said in a statement: "This is an issue of consent-something that our client never had the opportunity to give."

Likewise, Elden, now 30, who was four months old, when the image was made was on the cover, says he suffered lifelong damages like heavy loss in wages, education, and enjoyable life from the 1991 album cover.

Talking about Robert Fisher, who designed the cover, said Kurt Cobain watched a documentary about babies being born underwater, got inspired by the idea. Many still see the photo as a comic that satirically suggests the band is grasping for money after signing to a new major record label.

On the other hand, Kirk Weddle, who shot the image of Nirvana's breakthrough album cover photo, was friends with Elden's parents. Kirk asked if the 5-month-old Elden could be part of the photoshoot. Eden recalled the moment telling that his dad was like, 'Ah no problem, man. We will go down to the pool & throw him in; that will be it, which was no big deal.' But Elden wasn't happy with what it could become.

As of now, Elden claims never to be paid for his work, plus his parents never signed any form of release on the image being shot specifically. But, reports tell that Elden's parents received $250.

In the meantime. Elden sought damages of at least $160,000 from every 15 defendants involved. However, none of the defendants have yet responded to the lawsuit or commented on it publicly.

Surprisingly, Elden in 2016 volunteered to do his latest iteration of the cover naked, the iconic image of himself to mark the album's 25th anniversary. He told the New York Post newspaper- "Its cool but weird to be part of something so important that I dont even remember."
