Jussie Smollett is found guilty for filing a false police report that he was attacked by two masked men nearly a month ago.

The widely acclaimed actor Jussie Smollett reportedly is charged with one count of felony disorderly conduct for filing a false police report, the Cook County State's Attorney's Office said Wednesday evening.

The Empire actor is due to attend a court hearing in Chicago at 1:30 p.m. Thursday. Chicago police spokesman Anthony Guglielmi said CPD detectives are bound to contact the actor's legal team to carry out the viable negotiation of his surrender for arrest.

Smollett is currently not in custody. Guglielmi told ABC News that police are not actively looking for the actor adding,

"this is not a violent crime,"

But maintained,

"the longer this goes, the more we have to do what we have to do."

Guglielmi told ABC News

"Police do not know where Smollett is, his attorneys have not shared where he is at this point." 

He added,

"I know this can be difficult emotionally, and we hope he doesn't do anything terrible. We want to make this as diplomatic as possible. In the end, this is only a class 4 felony. He will get through this and we want to make it as easy as possible for him to do it. But again, it is about accountability," 

Detectives questioned two brothers as the prime suspects of attack but released them late Friday without charges. Police maintained a new light has been shed on the case from their interrogation of the two men and also clarified that they were no longer suspects.

On the night of the complaint, the brothers walked to the counter purchasing several items including ski masks, gloves, and baseball caps. They walked to their vehicle right after.

In fact, Smollett said in the complaint that the attackers were wearing masks. The security guard working that day said that he knew the brothers and also helped them to find the items they were looking for.

He told authorities that two men attacked him last month as he headed home after a morning stop at a Subway restaurant in downtown Chicago. The actor said two masked men chanted racial and homophobic statements pouring an unknown chemical substance to his body. The duo then fled the scene, said Smollett.

Despite the controversial case, his character in Empire Jamal Lyon is still intact as Fox decided not to cancel out his part. The media outlet maintained that the actor is nothing but a 'consummate professional' in the set.
